FP Guide Sample Sites Effective Date: [EFFECTIVE DATE]
By booking a trip, signing up for inquiries, submitting a form, calling, texting, or emailing FP Guide Sample Sites ("we," "us," "our," or "the Captain"), or using the website at fpsamplesite.com ("the Site"), you ("you," "your," "Customer," or "Angler") agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not book a trip and do not use the Site.
These Terms apply to every trip, charter, lesson, and service we provide.
FP Guide Sample Sites is a licensed fishing guide and charter service operated by . We operate on and provide guided fishing trips, instruction, and related services.
Where applicable, we operate under USCG license number and state guide license .
Deposit. A non-refundable deposit of [DEPOSIT AMOUNT] is required to reserve a trip. Your reservation is not confirmed until the deposit is received.
Balance. The remaining balance is due [BALANCE DUE TIMING] in cash, card, or any method we accept at the time of the trip. We reserve the right to require full payment in advance for certain dates, group sizes, or seasonal periods.
Payment processing. Card payments are processed through third-party payment processors. We do not store full card numbers on our systems.
If you cancel more than [CANCELLATION WINDOW] before your scheduled trip start time, your deposit will be held as credit toward a future trip booked within twelve (12) months of the original date.
If you cancel less than [CANCELLATION WINDOW] before your scheduled trip start time, or fail to show up, your deposit and any payments collected are forfeited and not refundable. The full trip rate may be charged.
Reductions in group size after booking do not reduce the trip rate.
The Captain has sole discretion to cancel, delay, shorten, or relocate any trip due to weather, sea conditions, water levels, mechanical issues, fish-and-wildlife closures, the safety of persons aboard, or any condition the Captain reasonably believes affects safety.
If we cancel a trip for weather or safety reasons before it begins, you may choose either: (a) reschedule the trip at no additional cost within twelve (12) months, or (b) receive a refund of any payments made, excluding non-refundable card processing fees where applicable.
If a trip is cut short after departure due to weather, safety, or angler conduct, the trip is considered fulfilled and no refund or rescheduling is owed. The Captain may, at their discretion, offer a partial credit.
You are responsible for your own fishing license. Every angler aged as required by [GOVERNING STATE] law must hold a valid fishing license and any required stamps or endorsements before boarding. Federal waters may require additional permits. We do not sell licenses; you can purchase one online before the trip.
You agree to comply with all applicable federal, state, and local fish-and-wildlife regulations, including bag limits, slot limits, seasonal closures, gear restrictions, and species-specific rules. Fines, citations, or penalties for regulatory violations are your responsibility, even if the violation occurred during a guided trip.
We reserve the right to refuse to retain or clean any fish that does not comply with applicable regulations.
Fishing, boating, and being on or near water carry inherent risks, including but not limited to: drowning, slips and falls, hooking injuries, propeller and engine injuries, exposure to weather and sun, seasickness, allergic reactions, encounters with fish and wildlife, collisions, capsizing, fire, equipment failure, and acts of other vessels or third parties.
By booking a trip, you knowingly and voluntarily assume all risks associated with the trip, whether foreseen or unforeseen, for yourself and on behalf of any minors in your party.
This Section is not intended to relieve us of liability for our own gross negligence or willful misconduct.
To the maximum extent permitted by law, FP Guide Sample Sites, , and any crew, contractors, or affiliates shall not be liable for:
Personal injury, illness, or death except where caused by our gross negligence or willful misconduct
Damage to, loss of, or theft of personal property brought aboard, including phones, cameras, sunglasses, fishing gear, clothing, vehicles, and trailers
Indirect, incidental, consequential, or punitive damages of any kind
Lost profits, lost wages, or lost vacation time arising from cancellation, delay, or curtailment of any trip
Where liability cannot be excluded by law, our total liability for any claim arising out of or related to a trip is limited to the amount you paid for that trip.
The Captain is in command of the vessel at all times. You agree to:
Follow all instructions from the Captain regarding safety, fishing, and vessel operations
Wear personal flotation devices ("PFDs") when required by the Captain or by law
Refrain from operating the vessel, the motor, or any equipment without explicit permission
Not bring illegal drugs aboard. Cannabis, even where legal in [GOVERNING STATE], is prohibited on federal navigable waters and is not permitted on any of our trips
Drink alcohol only with the Captain's permission and only in moderation; excessive intoxication may result in immediate trip termination
Not engage in fighting, harassment, reckless behavior, or any activity that endangers others
The Captain may terminate a trip immediately, return to dock, and forfeit any unused trip time without refund if you or any member of your party violates this Section.
Anglers under [MIN AGE] years old must have prior approval from the Captain before booking. A parent or legal guardian must be present aboard for the entire trip and must accept these Terms on the minor's behalf, including the Assumption of Risk and Limitation of Liability provisions.
Bring only what you need. We are not responsible for lost, damaged, or stolen personal property. Phones, cameras, and electronics on a boat are at constant risk of water damage; bring them at your own risk.
We may take photos or short videos during your trip and use them on our website, social media, Google Business Profile, advertising, and marketing materials, with no compensation owed to you. If you do not want your image used, please tell the Captain before the trip begins; we will respect that request.
By providing your phone number or email address to us โ through the website, a booking, an inquiry, or in person โ you agree to receive communications from us related to your trip and our services. This may include:
Trip confirmations and reminders
Booking and payment receipts
Weather and schedule updates
Trip recaps and review requests
Occasional marketing communications
Message frequency varies. Message and data rates may apply. Reply STOP to any text to unsubscribe from marketing texts; reply HELP for help. You can unsubscribe from marketing emails by clicking the unsubscribe link in any marketing email. Unsubscribing from marketing does not stop transactional messages related to a booked trip.
By providing your phone number, you also consent to receive automated messages and prerecorded or AI-assisted voice messages. Consent is not required as a condition of booking.
You agree to indemnify, defend, and hold harmless FP Guide Sample Sites, , and any crew, contractors, or affiliates from and against any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms, (b) your conduct or that of any minor in your party during a trip, or (c) your violation of any law or regulation, including fishing regulations.
These Terms are governed by the laws of the State of [GOVERNING STATE], without regard to conflict-of-law principles, except where federal maritime law applies. Any legal action must be brought in the state or federal courts located in [GOVERNING COUNTY], [GOVERNING STATE], and you consent to the exclusive jurisdiction of those courts.
You agree that any dispute will be resolved on an individual basis and not as part of a class action.
We may update these Terms at any time. The current version will always be posted at fpsamplesite.com. Your continued use of our services after a change is posted means you accept the change.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
